If you purchase any of the individual or Bulk web hosting services by Wisesolution, you agree or are inbound with all the mentioned terms and conditions. Customer Agreement

All the support and services rendered by Wisesolution to you in Terms of Services are applicable for the entire Term or Renewal Term. All customers, clients, users, and individuals who purchase the services from Wisesolution should agree on all the Terms and Conditions stated on TOC before signup. By processing or placing your order, you agree to employ our Licensed and authorized third-party software for your use. In addition, Wisesolution reserves all the right to suspend your account or eliminate you from accessing our services if we find our services are inappropriately used by you apart from our TOC.

Wise solution Services and Policies are subjected to the terms above and as follows:-

ACCOUNT SETUP

WE ACCEPT SIGNUP FROM ALL THE GLOBAL LOCATIONS AND PROCESS ACCOUNTS SET UP FOR THEM.

  • Once you are done with your payment option, we will set up a hosting account for you.
  • Before placing an order, make sure to provide the correct Primary Email Address and contact information to get notified of our latest updates and issues.
  • You're responsible if your account is terminated or suspended due to incorrect information.
  • Wise Solution is not responsible for a lapsed registration due to outdated contact information associated with the domain. If you need to verify or change this information, you should contact our sales/support team via email/chat support.
  • It is necessary to provide a government-issued Identification if you want to purchase a Dedicated Server. For high-risk transactions, ensure to scan the credit card for purchasing. If you fail to meet these requirements, the order may be considered fraudulent and denied.

CONTENT

  • Wisesolution reserves all the right to decline service and suspend your account at any time. All services provided by Us be used for lawful purposes ONLY. The laws of the IPC - Indian Penal Code (IPC - भारतीयदण्डसंहिता) apply. In Violation of any applicable law or TOC, Wisesolution takes instant actions without notifying you. Use of our services to infringe upon any copyright or trademark is prohibited.
  • Use of Our Services for the Website content that encourages or is incorporated with the below-mentioned activities is strictly prohibited. If you encounter using our services or are drawn into such activities, then Wisesolution is not responsible and terminates your account immediately.

-Forums and/or websites that distribute or link to warez/pirated/illegal content

-Adult Materials (Pornography, Erotic images, Obscene Content),

-Controlled substance sale without prior proof of appropriate permit(s)

-Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)

-Illegal Material (Copyrighted works, Commercial audio, video, or music files, and other offensive content)

-Warez - This includes but is not limited(Pirated Softwares, Emulators, Password Cracking, Phreaking, ROMS, IP spoofing, and Encrypting data)

-Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)

Examples of unacceptable material on all VPS/Dedicated servers include:

-Hateful/Racist/Harassment oriented sites

-Hacker focused sites/archives/programs/hacked or infected website

-Sites promoting illegal activities

-Forums and/or websites that distribute or link to warez/pirated/illegal content

-Bank Debentures/Bank Debenture Trading Programs

-Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)

-Any site found to host pornography, child pornography or linking to pornography, child pornography will be suspended immediately without notice.

  • Any account found to be in violation of another's copyright will be expeditiously removed or refused to access our services.
  • Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting.
  • If you believe that your copyright or trademark is being infringed upon, please email support@Wisesolution.in with the required information.

TRANSFERS

  • Our experts and the technical team always stand out to assist you in migrating your data from one server to another. However, these services are provided for the sake of the customer's welfare and ease of site management.
  • Migration services are catering as a courtesy service. We are not committed to the availability, possibility, or time required to complete an account transfer.
  • Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult. We will try our best but are not responsible if unable to migrate some or all account data.
  • In some exceptional cases, we may be unable to assist you in data migration from an old host.
  • Cost-effective Charges are applied to data migration services with all our hosting packages. You can migrate your data at a low cost, @ Rs30 per account, as the total data migration services are applicable for unlimited accounts.

KYC DOCUMENT

  • KYC Documents are compulsory for Indian Clients who want to make payment via the Coin Base method.
  • For other locations apart from India, we ask for the KYC documents if required or necessary.
  • We ask for the KYC Documents if you are found to be Violating our TOC.
  • Money is non-refundable if any user denies the KYC documentation under Policy Violation.
  • Every User/Reseller requested to provide the correct and authorized information for proper communication before placing an order.
  • You(User and/or Reseller) are solely responsible for the Upgrade, Migrations, or any Informational details in case of providing the false information.
  • Every User/Reseller advised keeping their eye on Inbox for being updated with our Services and updates.

DATA BACKUP

  • The wise solution will never be responsible for any kind of data loss (Files, Email, Personal data setting, etc../or which data resides on your account) in any condition(site hacked or server hardware failure, server & site maintenance time, any mistake which is made by you).
  • Any file over 40MB in size will not be backed up onto our backup servers and will not be recoverable in the event of server failure.
  • Wise solution does not provide data backup of any shared account consuming more than 5 gigs of disk space. (Except database)
  • You need to backup your data by yourself. Copying all your data to a secondary drive is suggested, which protects against data loss in a drive failure.
  • Use our services at your sole risk. We do not keep any backups of your server. Nor do we provide backup services for accounts that have been suspended or terminated due to any reason.

Domain Payments-

Domain Registrations: No refund is applicable once the domain is registered.

Domain infringement: You cannot register a domain name that is similar to a trademarked domain/a domain similar to a brand and is engaged in a business providing similar goods or services. Any person trying to register such a domain name will be held liable for infringement of the Trademark. Example: Flipkart sale.in, bajajfinancecs.com, adtyabrlafnanc.co.in

Domain Renewal: We will send you reminders to renew your domain one month before the expiry. For failure or delay in the renewal of a domain, we are not responsible. Once a domain is renewed no refunds will be given.

PAYMENT POLICY

  • Wise Solution reserves the right to change the monthly and yearly payment amount and any other charges at any time.
  • If you make payment via Credit Card, Debit Card, Net Banking, PayPal, the account will be set up immediately once the payment is confirmed. If paying by a cheque, please allow five days for the cheque to clear. If paying via postal orders or cash, your account will be set up on the same day.
  • The 7-days money-back guarantee is only applicable for first-time signups. Second-time and subsequent signups are not eligible for the same.
  • For instance, if you've had an account with us before, canceled, and signed up again, or if you have opened a second account with us, you will not be eligible for a refund.
  • 5days grace period from the time the invoice is generated and when it must be paid.

CANCELLATION PROCESS

  • You can discontinue our services at any time. For that, you need to make a cancellation request through the client area. Before requesting, you need to clear all the dues(if any).
  • You can instantly request cancellation once your subscription period expires. If you choose immediate cancellation, you will no longer have access to your hosting services. If cancellation is selected after the tenure period, you will continue with your services until the end of your prepaid term.
  • Before cancellation requests, it's your sole responsibility to backup your data. Once you make the cancellation request, all your data stored is deleted from our server. The data can not be restored or retrieved.
  • Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, canceled, signed up again, or opened a second account with us, you will not be eligible for a refund.
  • There is no cancellation and refund applicable for Annual basis billing cycle and custom order.
  • The refund money will be credited into the Client Portal Account instead of your personal(paying) account within 7 Days. You can use the credited amount anytime in the future to buy hosting services from Wisesolution.

Taxes

  • All the hosting prices mentioned on our website are exclusive of all taxes. To know the final pricing with taxes, you can use the cost calculator.
  • Once you add services to your cart, the total amount with taxes will be provided in your final invoice. The taxes amount is non-refundable.

Late Payment or Non-Payment

  • Your account is suspended or terminated in case of unpaid invoices.
  • Your suspended account will be restored when you clear all the due invoices. After that, you are enabled to access your services.
  • Your account is treated as a completely new account once Wisesolution terminates it.
  • If you fail to renew your hosting subscription on time, you will have to pay an additional 10% charge on your invoice to continue with your services.
  • We will not activate new orders if you leave with any dues.

Zero Tolerance Spam Policy

  • Wise Solution takes a zero-tolerance approach to send Unsolicited Commercial Email (UCE) or SPAM over our network. We do not allow or permit others to use our network to transact in UCE or any other offensive material or content.
  • Wise solution customers are prohibited from hosting sites or information that UCE advertises from other networks. Also, prohibit the illicit use of our hosting services.
  • UCE or Spam policy violations carry severe penalties, including termination of service or account suspension without any intimation or notice.
  • Upon notification of an alleged violation of our SPAM policy, Wise Solution may restrict customer access to the network to prevent further violations.
  • Wise Solution reserves the right to pursue civil remedies for any costs associated with investigating a substantiated policy violation.
  • You will notify law enforcement officials if the violation is believed to be a criminal offense.
  • Customers are ultimately responsible for their end-user actions.
  • Customers should develop a similar or stricter policy for their client's Sites advertised via SPAM (Spamvertised) not be hosted on our servers. This provision includes but is not limited to SPAM sent via fax, email, instant messaging, or Usenet/newsgroups.
  • No organization or entity listed in the ROKSO may be hosted on our servers.
  • Any account incorporated with IP space being blacklisted will be immediately suspended and/or terminated.
  • Wise Solution reserves the right to change or disable any website, account, database, modifications, or another component that does not comply with its established policies in an emergency at its sole discretion.
  • Wise Solution reserves the right to charge the account holder used to send any unsolicited e-mail, a clean-up fee, or any charges incurred for blacklist removal. This cost of the clean-up fee is entirely at the discretion of Wise Solution.

Unlimited Hosting-

What "Unlimited" means Unlimited Disk Space/Bandwidth/Website Plans. This means that we do not set a limit on the amount of bandwidth, websites, or disk space you may use in the normal operation of a personal or small business website, provided it complies with this Agreement. However, in the event your service usage or content presents a risk to the stability, performance, or uptime of our servers, data storage, networking, or other infrastructure, you may be required to upgrade to a VPS, or we may take action to restrict the resources your website is utilizing.

-What happens in case of Noncompliance?

If notified by our monitoring team we contact the administrator of the website causing the issue and try to resolve the matter. Our services may not be used for archiving or storing electronic files which are not available directly through the website.

-What is “normal” usage?

Normal usage means that the customer makes efficient use of the unlimited hosting provided in an ethical way pertaining to the use for which it was taken. An example of in compliance may be storing a large number of audio and video files that may not be associated with the website thereby requiring more resources to support the website

-Why are the normal usage guidelines in place?

Wise Solution offers to host in a shared environment due to which each site may have an impact on other websites. Through our years of existence in the business, we have never faced any disruption in the service however it is important for us to face any future instances. This event is an unusual event but we want our customers to realize it before actually purchasing it.

-Guidelines for Reseller Hosting

Wise Solution may put a restriction to the number of domains to which it can host its services depending on the load which the hosted domains are using. This is to keep the servers running at normal efficiency.

Bandwidth Usage

The wise solution provides you up to unlimited bandwidth. It varies with the hosting package you purchase.

Wise solution reserves the right to:

-Suspend the account until the start of the next allocation,

-Suspend the account until more bandwidth is purchased at an additional fee

-Suspend the account until you upgrade to a higher level of package

-Terminate the account and/or charge you an additional fee for the overages.

-Unused transfer in one month cannot be carried over to the next month.

Uptime Guarantee

  • We will strive our best to offer 99.9% Network and server Uptime.
  • We will strive to provide 24*7 for as long as you have paid for them.
  • You must acknowledge that the occasional unavailability of the services cannot be avoided due to the nature of web hosting technology. Sometimes there are equipment malfunctions.
  • We undertake periodic maintenance procedures or repairs. Still other times, there are causes beyond our control like power failures, interruption, telecommunication failure, digital transmission links, hostile network attacks, network traffic, and other occurrences. We have not promised to provide you with such uninterrupted service.
  • Third-party monitoring service reports may not be used for justification due to a variety of factors, including the monitor's network capacity/transit availability.
  • Server Uptime is defined as the reported uptime from the operating system and the Apache Web Server, which may differ from the uptime reported by other individual services.

Price Change

  • The amount you pay for the web hosting will never change once you purchase the hosting with existing plans.
  • We reserve the right to change prices listed on Wisesolution. in, and the right to increase the number of resources given to plans at any time.

Coupons

  • Discounts and coupon codes are reserved for first-time accounts *or first-time customers* only and may not be used to purchase a domain registration unless otherwise specified.
  • If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date.
  • Appropriate invoices will be added to the account if an account is found in violation of these policies throughout a review by our sales department.
  • Coupon abuse will not be tolerated and may result in the suspension or termination of the account.

Indemnification

Customers agree that they shall defend, indemnify, save, and hold Wise Solution from any demands, liabilities, losses, costs, and claims, including reasonable attorney's fees against Wise Solution, its agents, and its customers, officers, and employees.

Customer agrees to defend, indemnify and hold harmless Wise Solution against liabilities arising out of;

(1) Any injury to person or property caused by any products sold or otherwise distributed in connection with Wise Solution;

(2) Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;

(3) Copyright infringement and

(4) The indemnification obligations under this section shall survive any termination or expiration of this Agreement or your use of this Site or the Services found at this Site.

CHANGES TO THE TOS

Wise solution reserves all the rights to revise and change its policies at any time without warning or intimation. So, keep visiting the page and be advised to check your emails for regular updates.

TRAILS

  • Wisesolution does not provide any free trials. If you want any trial before any purchase, you should pay additional charges to employ services (Demo charges will depend on the plan and location). The charge is non-refundable.
  • For the trial, you have to raise a ticket accordingly. Our technical team will provide you complete details.

INODES

  • The use of more than 10,000 Inodes and 50,000 inodes on the UNLIMITED Plan or any shared account may potentially result in a warning first.
  • Accounts found to be exceeding the 100,000 inode limit will automatically be removed from our backup system to avoid over-usage.
  • Every file (a web page, image file, email, etc.) on your account uses up 1 inode.
  • Sites that slightly exceed our inode limits are unlikely to be suspended.
  • Accounts that constantly create/ delete large numbers of files and have hundreds of thousands of files cause a file system regularly. The damage may be flagged for review and/or suspension.
  • The primary cause of excessive inodes is that users leave the enabled catchall address but never check their primary account mailbox.
  • Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit.
  • To disable your default mailbox, login to cPanel and choose "Mail", then "Default Address", "Set Default Address", and then type in: :fail: No such user here.

SHARED (NON-RESELLER ACCOUNTS) / SEMI-DEDICATED SERVERS

  • Use of our shared account as a backup/storage device is restricted, except for one cPanel backup of the same account. Please do not take backups of your backups.
  • Users are restricted from reselling the shared accounts with other people.
  • Shared accounts may not resell web hosting to other people, if you wish to resell hosting you must use a reseller account
  • Wise solution does not provide backups for the Semi-Dedicated Servers. You must have to back up your server data.

DISCLOSURE TO LAW ENFORCEMENT

Wise solution may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies. (This is done if we find any clients infringing our TOS for any unlawful activities).

ABOUT BLOCK COUNTRIES AND SECURITY

  • If Wisesolution finds any kind of hacking attack from a specific country, we will block it permanently until the hacking attack does not stop.
  • A wise solution can take any decision against a client if found to harm and violate security reasons.

Reseller: Client Responsibility

Resellers are responsible for supporting their clients. Wise Solution does not provide support to our Reseller's Clients. If a reseller's client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients' behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients. Wise Solution will hold any reseller responsible for any of their client’s actions that violate the law or the terms of service.

DISCLAIMER

  • Wisesolution shall not be responsible for any kind of your business loss or damages. We do not make warranties of any kind, expressed or implied, for the services we provide.
  • The wise solution does not make any warranties about the completeness, reliability, and accuracy of this information. Any action you take upon the information you find on this website (Wisesolution) is strictly at your own risk. The wise solution will not be liable for any losses and damages in connection with the use of our website.
